Below is our new Privacy Policy

All of us at Flussbad Berlin e.V. (hereinafter referred to as "Flussbad") take the protection of your data very seriously. We strictly adhere to the data protection laws of the Federal Republic of Germany (BDSG) as well as the Telemedia Act (TMG) and the European General Data Protection Regulation (EU-GDPR). If reference is made in this Privacy Policy to the GDPR, we would like to make it clear that this applies only as of 25 May 2018. Prior to that date, the legal basis is provided by the BDSG. This Privacy Policy applies to the usage of Flussbad’s digital products and services via PC, smartphone, tablet and all other internet-enabled mobile devices. Please note that our digital products and services may contain links to websites operated by third-party service providers who are not covered by this Privacy Policy.

Newsletter

Our Newsletter allows us to provide you with interesting and up-to-date information via e-mail. In order to be able to send you our Newsletter, we require your consent in advance. Each of the products and services advertised as part of the Newsletter are named in the declaration of consent. If you choose to receive the Newsletter, we will require an e-mail address as well as information that allows us to verify that you are the owner of that e-mail address and that you agree to receive the Newsletter. The precise information we require in order to be able to send you our Newsletter is limited to your e-mail address and your full name. Any other data you provide us with is strictly voluntary and will be used to address you personally. In addition, we store your IP address and the date and time of your registration and confirmation. The purpose of this procedure is to be able to provide proof of your registration and, if necessary, to be able to inform you about a possible misuse of your personal data. We do not collect any other data in this context. We will use this data solely to send you the requested Newsletter. To the extent that we make use of a ‘Data Processor’ to send you our Newsletter, we will, of course, adhere to all applicable data protection laws.

You can revoke your consent to receive the Newsletter at any time and thereby unsubscribe from the Newsletter. In order to cancel your subscription, simply click on the link provided in each Newsletter e-mail. You can also send a message (e.g. via e-mail, fax, letter) requesting a cancellation to the address indicated above. The processing of your data is carried out on the basis of your consent in accordance with Art. 6 Par. 1 Point a. of the GDPR. You can revoke your consent at any time. The lawfulness of the data processing carried out prior to the point of revocation remains unaffected.

Processing of http Protocol Data

Every time a user accesses the internet products and services of Flussbad and every time a file is accessed, data regarding this process is temporarily stored in a log file and processed. Before each dataset is saved, it is anonymised by means of changing the IP address. In other words, it is impossible to trace back the data collected to a specific natural person. The following data is stored for each access: anonymised IP address, name of the retrieved files, date and time of the retrieval, amount of data transferred and a message as to whether the retrieval was successful. These data are evaluated solely for statistical purposes and to improve our products and services; after that, they are deleted. These data are not used in any other way and are not passed on to third parties.

Use of Cookies / Use of the Analytics Software Matomo

Our website uses the web analysis application Matomo. Matomo uses ‘Cookies’, which are text data that are saved on your computer and which enable us to carry out an analysis of how our website is used. The usage information created with the help of Cookies – which includes your shortened IP address – is transmitted to our server and saved for usage analysis purposes. In turn, this helps us optimise our website. Your IP address is anonymised in this process so that you – as a user of our website – remain completely anonymous to us. The information generated via Cookies about your use of our website will not be passed on to any third parties. You can disallow the use of Cookies by selecting the appropriate settings in your browser software. However, please note that if you block Cookies, it might prevent you from making use of the full breadth of the functions on our website. If you would like to prevent the storage and evaluation of the data resulting from your visit, you can revoke your consent to the storage and usage at any time. In this case, a so-called “Opt-Out Cookie” will be stored in your browser and will prompt Matomo to refrain from collecting any session data. Please note that when you delete your Cookies, this also deletes the Opt-Out Cookie; in this case, you may be asked to reactivate your consent to the use of Cookies.

Your Personal Data

When you register to receive the e-mail Newsletter and/or make use of an online request or contact form, we will ask you to provide some personal information. This data will be forwarded via e-mail from our web server to the e-mail post box of our office. Please note that communication via the contact form is not encrypted. We use your personal data solely to provide you with the application or service you selected. If the application or service is limited to a certain time, Flussbad will delete your data as soon as the application or service has terminated. Any postal and/or e-mail addresses that you provided in the context of an inquiry or a request for information material will be used exclusively for correspondence and shipping purposes. All data will be located on servers within the European Union (EU) and the European Economic Area (EEA).

Data Transfer to Third Parties

Flussbad will transfer your data to third parties without your written consent only if the following applies: If a subcontractor or representative agent – that is, a person we are employing exclusively for the purpose of providing the products and services you requested – require these data. Unless we expressly inform you otherwise, such auxiliary persons are entitled to use the data solely to the extent that it is the necessary to provide the products and services. If there is an enforceable administrative or judicial order to do so. If it is necessary so as to prevent the improper use of our products and services in a legally permissible manner.

Data Retention Period

As a matter of principle, we will delete your data as soon as it is no longer necessary for the purposes mentioned above, that is, unless temporary storage is obligatory. This means that we store your data in accordance with legal obligations relating to documentation and retention that arise from Germany’s Commercial Code (‘Handelsgesetzbuch’) and the Tax Code (‘Abgabenordnung’), among others. These laws stipulate storage periods of up to ten full years. In addition, we retain your data for the period of time in which any claims can be made against our enterprise (a legal limitation period of three years or up to thirty years).

Our website contains links to external pages. These links are specially marked. The content of these external pages is not found on our server. When we set up these links, we were careful to check the content of the links. However, we cannot guarantee that the content contained on these external pages has been subsequently changed by the respective providers. If you notice that the content of an external provider violates the law, we ask that you inform us as soon as possible. This Privacy Policy applies only to content found on our servers.

Rights of the Affected Person

In accordance with all applicable legal requirements, you have the right at any time to request and receive information about your stored personal data, its origin and the person who holds it, the purpose of the data processing and, if necessary, the right to request the correction, blocking or deletion of this data. The provision of information about your stored personal data is free of charge. Please do not hesitate to call us with any questions you might have about this or any other subject relating to personal data using the contact information mentioned above (‘Data Controller’). You also have the right to restrict the processing of your data and to have the data you provided disclosed to you in a structured, conventional and machine-readable format. If you have given us consent to process your personal data for a specific purpose, you may revoke your consent at any time with future effect. If we process your data in order to safeguard legitimate interests, you are permitted to object to this processing for reasons that arise from your particular situation. You also have the option of contacting an official data protection supervisory authority.
